IMPORTANT — READ CAREFULLY. These Terms of Service ("Terms") form a legally binding agreement between you ("you," "User") and Intelliquinte L.L.C. (dba Intelliquinte, "we," "us," "Company") governing your access to and use of the Dear Nobody service at dearnobody.org and related domains (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Plain-Language Summary

What Dear Nobody Is:

  • An anonymous submission platform for personal letters, confessions, and stories
  • A space to express what you couldn't say out loud
  • A moderated archive that may publish your work (if you choose to share publicly)

What We Don't Do:

  • Require accounts or emails
  • Track or profile you
  • Provide crisis intervention (we're not a crisis service)

If you are in immediate danger: Call emergency services or a crisis hotline. In the U.S., call or text 988.

2. Definitions

Content
Any text, letter, confession, or other material submitted by a User through the Service.
Public Submission
Content designated by a User for publication in The Mailbox or inclusion in derivative works.
Private Submission
Content designated by a User to remain internal to moderators/curators and not published.
Public ID
A unique identifier visible with published submissions, used for reference and lookup.
Private ID
A unique identifier provided only to the submitter, required for access, consent management, and deletion. Not stored in our database — only a one-way hash is retained. We cannot recover or see your Private ID.
The Mailbox
The public-facing archive where approved submissions are displayed.

3. Eligibility & Age

You must be at least 13 years old to submit content to Dear Nobody. If your local jurisdiction requires a higher minimum age for online services, you must meet that age.

By using the Service, you represent that:

  • You are at least 13 years old
  • If you are under 18, you have parental or guardian consent
  • You meet all age requirements in your jurisdiction

If you are under 18, your parent or guardian's consent to these Terms includes consent to the arbitration agreement in Section 20.

The 18+ Archive is restricted to users 18 years or older. We use age-gate confirmations but do not perform formal identity verification. Underage submissions discovered in the 18+ Archive will be removed.

4. No Accounts; Privacy & Anonymity

The Service operates without user accounts. We do not require names, emails, or registration to submit content.

  • You may optionally sign off with a name, pseudonym, or remain anonymous
  • Any signature you provide is stored only with your submission record
  • We do not intentionally link published Content to identifying metadata
Your anonymity is the default. We are designed for minimal data collection: we do not require accounts, we do not intentionally link content to identifying metadata, and we do not intentionally retain IP addresses in our application systems. However, we cannot guarantee complete anonymity in all circumstances. Our infrastructure providers may process network data; law enforcement may attempt attribution through other means; and we may be required to disclose data under legal process. See our Privacy Policy for details.

4.1 Submission IDs & Local Vault

Upon submission, you receive two unique identifiers:

  • Public ID: Stored on our servers, visible if published
  • Private ID: Provided only to you; we store only a hash for verification. We cannot recover your Private ID.

The optional "My Vault" feature allows you to store these IDs locally on your device using browser local storage. This data never leaves your device — it is not transmitted to or stored on our servers. You are solely responsible for backing up your IDs. If you clear your browser data or use a different device, locally stored IDs will be lost.

5. Submission Types & 18+ Handling

5.1 Public Submissions

  • May be published in The Mailbox, archived, or included in derivative works
  • Are assigned a visible Public ID
  • Remain anonymous unless you include identifying information (which we discourage and may redact)

5.2 Private Submissions

  • Remain internal and viewable only by moderators/curators
  • Will not be published without your explicit, separate permission
  • May still be subject to legal disclosure requirements

5.3 The 18+ Archive

Explicit sexual content that complies with community standards may be placed in a separate, age-restricted 18+ Archive.

The 18+ Archive is NOT:
  • A space for pornographic or exploitative material
  • A place for any sexual content involving minors (strictly prohibited)
  • Allowed for sexualized violence or fetishized trauma
  • A loophole for violating community standards

Submissions may be refused for the 18+ Archive if they violate policies, even if explicitly marked.

6. License, Promotion, Research & Rights

6.1 License Grant for Public Submissions

By posting a Public Submission, you grant Intelliquinte L.L.C. a non-exclusive, worldwide, royalty-free, sublicensable, transferable, perpetual license to:

  • Reproduce, publish, distribute, and display the Content
  • Adapt, translate, and create derivative works
  • Use the Content in any medium (digital or print)
  • Use the Content for editorial, archival, educational, or commercial purposes in connection with the Service

6.2 Promotional Use Requires Additional Consent

Notwithstanding Section 6.1, we will not use your submission in promotional materials (paid advertising, marketing campaigns, product branding, merchandise) without your explicit additional marketing consent.

The base license in 6.1 covers editorial, archival, publication, and derivative uses associated with the Service itself.

6.3 Research, Scholarship & Archival Use

With research consent, anonymized Public Submissions may be used for:

  • Academic research and scholarly publication
  • Teaching and educational purposes
  • Historical archiving and content analysis
  • Quantitative or qualitative research studies

Research use never involves attempting to identify submitters.

6.4 Private Submissions

Private Submissions are subject only to a limited internal license for review, archiving, and administration. They will not be used publicly or in promotional materials without your express, separate written permission.

6.5 Moral Rights Waiver

To the extent permitted by applicable law, you irrevocably waive any moral rights (including rights of attribution and integrity) necessary to effectuate the license in Section 6.1, provided that Intelliquinte will not intentionally publish materially altered Content in a manner that distorts the fundamental meaning or intent.

6.6 Retention of Copyright

You retain copyright in your Content. Nothing in these Terms transfers ownership of your copyright to Intelliquinte L.L.C. You are granting a license, not transferring ownership.

6.7 Consent Management & Withdrawal

You may manage your consent through the Access & Control interface:

6.7.1 Effects of Changes (Before Publication Only)

If you make changes before your submission is published:

  • Switching to private: Your submission will not be published and is removed from moderation queues. Research and marketing consents are automatically revoked
  • Research consent: Your submission will not be used in any future research
  • Marketing consent: Your submission will not appear in promotional materials or merchandise
Why settings are locked after publication: Once published, your letter becomes part of the permanent archive. Allowing changes after publication would compromise archive integrity. However, you can always delete your submission entirely.

6.7.2 Effects of Deletion (Available Anytime)

Deletion is a separate action from consent withdrawal. You may delete your submission at any time—before or after publication. Deletion is immediate and comprehensive:

  • Immediate data scrubbing: Upon deletion request, all content data is permanently removed from our production database — including your letter text, encrypted content, pseudonym, recipient, editor notes, and AI analysis results
  • Consent revocation: Any research or marketing consents associated with your submission are automatically revoked
  • Status update: Your submission's status is set to "deleted" and a placeholder notice replaces your content, indicating it was removed at the author's request
  • Backup purge: Remaining copies in backup systems are purged within 30 days
  • Printed materials: Already-circulated printed materials cannot be recalled, but your content will be excluded from all future editions
  • Research already conducted: Deletion cannot retroactively affect research already completed or published, but prevents any future research use

Deletion permanently scrubs all your data. If you want to keep your letter in the archive but change consent settings, you must do so before publication.

7. Prohibited Content & User Obligations

You must NOT submit content that:

  • Identifies private individuals — Contains personal data (names, addresses, contact info) used to deanonymize others
  • Involves minors sexually — Any sexual content involving minors is strictly prohibited and will be reported to authorities
  • Contains hate speech — Discrimination, slurs, or content targeting protected groups
  • Promotes violence — Graphic violence, gore intended to shock, or threats
  • Encourages self-harm — Instructions or glorification of self-harm or suicide
  • Harasses individuals — Targeted harassment, bullying, or intimidation
  • Is spam or advertising — Commercial content, promotions, or solicitations
  • Infringes rights — Copyright, trademark, or privacy violations
  • Illegal activity — Instructions for illegal acts or content that violates applicable law

By submitting, you represent and warrant that you own or have sufficient rights to the Content.

8. Automated Access, Scraping & Data Harvesting

8.1 Prohibited Automated Activities

You may NOT use automated means to access, collect, or interact with the Service, including but not limited to:

  • Web scraping — Using bots, crawlers, spiders, or scrapers to extract content, data, or information from the Service
  • Data harvesting — Systematically collecting user submissions, content, or any data from the Service
  • Email collection — Harvesting, collecting, or compiling email addresses or contact information displayed on or submitted to the Service
  • Automated submissions — Using scripts, bots, or automated tools to submit content to the Service
  • API abuse — Accessing our serverless functions, APIs, or backend services without explicit written authorization
  • Database access — Attempting to directly access, query, or extract data from our databases
  • Bulk downloads — Downloading, copying, or archiving substantial portions of the Service content
  • Mirroring — Creating copies, mirrors, or replicas of the Service or its content
  • AI/ML training — Using content from the Service to train artificial intelligence, machine learning models, or language models without explicit written consent
  • Commercial harvesting — Collecting content for commercial purposes, resale, or redistribution

8.2 Robots.txt Compliance

All automated tools, bots, and crawlers must comply with our robots.txt file located at dearnobody.org/robots.txt. Ignoring, bypassing, or circumventing robots.txt directives constitutes a violation of these Terms and may violate applicable law.

8.3 Rate Limiting & Access Controls

We employ technical measures to protect the Service, including:

  • Privacy-preserving rate limiting using temporary session hashes (no IP logging)
  • Persistent rate limiting that survives server restarts to prevent abuse
  • Bot detection and challenge systems (Cloudflare Turnstile)
  • Behavioral analysis and anomaly detection
  • Brute force protection for submission access

Attempting to circumvent, bypass, or defeat these security measures is strictly prohibited. Note: We do not use IP-based blocking; our rate limiting uses privacy-preserving session hashes that cannot identify individual users.

8.4 Permitted Search Engine Crawling

We permit legitimate search engine crawlers (such as Googlebot, Bingbot) to index public informational pages in accordance with our robots.txt file. This permission:

  • Is limited to pages explicitly allowed in robots.txt
  • Does not permit access to restricted areas, APIs, or submission endpoints
  • Does not grant rights to use content for AI training
  • May be revoked at any time

8.5 Exceptions & Authorization

If you require automated access for legitimate purposes (academic research, accessibility tools, etc.), you must:

  1. Contact us at support@dearnobody.org with a detailed explanation
  2. Receive explicit written authorization before proceeding
  3. Comply with any conditions or limitations we impose

8.6 Legal Consequences

Violations may result in:
  • Immediate blocking of IP addresses and access
  • Reporting to your internet service provider or hosting provider
  • Legal action under applicable laws including the Computer Fraud and Abuse Act (18 U.S.C. § 1030), DMCA, and state computer crime laws
  • Civil liability for damages, including statutory damages where available

We reserve the right to monitor for violations and pursue legal remedies against scrapers, data harvesters, and unauthorized automated access where we have evidence of violations.

9. Moderation, Reporting & Removal

9.1 Content Review

All submissions undergo moderation review before publication. We reserve the right to:

  • Refuse, remove, edit, or unpublish Content at our discretion
  • Redact identifying information (names, locations, etc.)
  • Keep submissions private instead of publishing
  • Apply content warnings or age restrictions

We strive to moderate content but cannot guarantee that all policy violations will be identified or removed before publication. Since we don't collect contact information, we make these decisions without prior notice to the submitter.

9.2 Reporting

Use the Report button on any post to flag violations. Reports are reviewed by moderators. Do not engage with problematic content—report it instead.

9.3 Deletion Requests

To request deletion of your Content:

  1. Use the Access & Control interface with your Public ID and Private ID
  2. Or email support@dearnobody.org with both IDs

Deletion is processed immediately. All content data — including your letter text, encrypted content, pseudonym, AI analysis, and associated consent records — is permanently scrubbed from our production database the moment you confirm deletion. Backup copies are purged within 30 days. Deletion is subject to legal obligations: when required by law, we must retain content until the hold is released (see Section 12). Note: removal from third-party caches, search engines, or printed copies may be beyond our control.

We Cannot Delete on Your Behalf: Because we do not store your Private ID (only a hash), we cannot verify your identity to delete content on your behalf. You must provide both IDs. This protects you from unauthorized deletion requests.

9.4 Moderation Records

We maintain private moderation logs for legal and safety purposes.

10. Appeals

If your Content is removed and you believe this was in error:

  1. Email support@dearnobody.org within 14 days of removal
  2. Include both your Public ID and Private ID
  3. Explain why you believe the removal was incorrect

We will review your appeal and issue a final decision within 7 business days. Appeal decisions are final.

11. DMCA & Copyright

We comply with the Digital Millennium Copyright Act (DMCA). If you believe content on Dear Nobody infringes your copyright, you may submit a DMCA takedown notice to our designated agent.

11.2 Takedown Notice Requirements

Your DMCA notice must include:

  1. Identification of the copyrighted work you claim has been infringed
  2. Identification of the material you claim is infringing, with sufficient information for us to locate it (URL preferred)
  3. Your contact information (name, address, email)
  4. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner
  6. Your physical or electronic signature

11.3 Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification including:

  1. Identification of the removed material and its location before removal
  2. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  3. Your name, address, and consent to jurisdiction in Wake County, NC
  4. Your physical or electronic signature

11.4 Repeat Infringers

We may terminate access for users who are repeat copyright infringers. Given our anonymous submission model, this may include refusing future submissions associated with known infringement patterns.

12. Data Retention & Privacy

12.0.1 Legal Hold Exception. When required by law (e.g., court order, subpoena, preservation request), we must retain content regardless of your deletion request until the legal hold is released or expires. This is a legal obligation, not a choice. If your submission is subject to a legal hold, you will be notified when you attempt deletion.

We minimize data collection by design:

  • Submissions and IDs are retained until deletion is requested or as required by law
  • We do not intentionally retain IP addresses, browser fingerprints, or tracking data at the application level. We do not receive or store infrastructure provider logs. Our infrastructure providers (Cloudflare, Supabase) may process network data as described in our Privacy Policy. We do not have access to or control over those provider logs.
  • Consent records are maintained for legal compliance and are automatically revoked upon submission deletion
  • Non-deleted submissions are retained indefinitely as part of Dear Nobody's permanent archive. You may request deletion at any time using both your Public ID and Private ID
  • When you delete your submission, all content data (letter text, encrypted content, pseudonym, AI analysis, metadata) is permanently scrubbed from production databases immediately. Backup copies are purged within 30 days. Deletion is subject to the Legal Hold Exception above.

12.1 Data Security

We employ industry-standard security measures:

  • Encryption in transit: All data transmitted between your device and our servers is encrypted via TLS/HTTPS
  • Encryption at rest: Stored submissions and associated data are encrypted at rest using ECDH-P256/AES-GCM
  • Access controls: Database access is restricted to essential administrative personnel only, with all access logged
  • Privacy-preserving hashing: Private IDs are stored as one-way hashes, meaning we cannot reverse-engineer or read your Private ID

12.2 Error Monitoring

We collect privacy-preserving, anonymized technical error data to maintain and improve Service stability. This monitoring:

  • Captures only generic error types, stack traces, and page URLs
  • Automatically redacts any identifying information from error messages
  • Does not log IP addresses, user agents, session identifiers, or any personally identifiable information
  • Aggregates errors for debugging purposes and de-duplicates identical errors
  • Applies to both the main Dear Nobody website and the administrative dashboard

13. Third-Party Services

Dear Nobody uses the following third-party services to operate:

Cloudflare

DNS, CDN, DDoS protection, and Turnstile bot verification. Cloudflare may process technical data as part of security operations.

Cloudflare Pages

Website hosting and serverless functions for form processing and API operations.

Supabase

Database storage for submissions, consent records, and moderation data. Supabase Realtime is used for live data synchronization across the administrative dashboard. Supabase Auth is used for moderator and administrator authentication.

13.1 Transparency

We are committed to transparency about how we operate. We maintain a live Transparency Ledger with real-time platform statistics pulled directly from our database. We also intend to publish periodic quarterly reports that may include:

  • Total number of submissions received and published
  • Content moderation actions taken (removals, redactions, content warnings applied)
  • Number and type of legal requests received (court orders, subpoenas, law enforcement requests)
  • Mandatory reports filed (e.g., NCMEC referrals)
  • Legal holds placed and released
  • Deletion requests received and processed
  • User content reports received and reviewed
  • AI analysis statistics (crisis detections, flagging accuracy, human override rates)

All transparency data does not contain any information that could identify individual users or submissions. See our Transparency Ledger for current live statistics.

These services are essential for operating Dear Nobody. By using the Service, you acknowledge that these providers may process data as described in their respective privacy policies.

14. Disclaimers & Limitation of Liability

14.1 "As Is" Service

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Non-infringement of third-party rights
  • Uninterrupted or error-free operation
  • The Service meeting your specific needs or expectations
  • Results obtained from use of the Service

14.2 Content Disclaimer

We do not verify user submissions. Content represents the views of submitters, not Intelliquinte L.L.C. We are not responsible for the accuracy, safety, or legality of user-submitted content.

Reading content on Dear Nobody is at your own risk. User-submitted content may contain:

  • Emotionally challenging or triggering material
  • Personal opinions that may be offensive to some readers
  • Descriptions of difficult life experiences
  • Mature themes (even with content warnings)

While we moderate content and provide trigger warnings, we cannot guarantee all potentially harmful content will be identified or removed.

14.3 Not a Crisis Service — IMPORTANT

⚠️ DEAR NOBODY IS NOT A CRISIS INTERVENTION SERVICE

We are an anonymous letter-writing platform, NOT a mental health service, crisis hotline, therapy provider, or emergency service.

If you or someone you know is experiencing a mental health crisis, please contact emergency services or a crisis hotline immediately:

  • Emergency: Call 911 (US) or your local emergency number
  • U.S. Crisis Line: Call or text 988 (Suicide & Crisis Lifeline)

By using this Service, you acknowledge and agree that:

  • Intelliquinte L.L.C. does not provide professional mental health advice, counseling, or treatment
  • Submitting a letter does not create a therapeutic or professional relationship
  • We may not read or respond to submissions in a timely manner (or at all)
  • Writing to Dear Nobody is NOT a substitute for professional help
  • We are not responsible for any actions taken or not taken based on submissions

14.4 No Professional Advice

Nothing on this Service constitutes:

  • Medical, psychological, or psychiatric advice
  • Legal advice or legal representation
  • Financial or investment advice
  • Professional counseling or therapy

Any information or content on the Service is for general informational and expressive purposes only. Always consult qualified professionals for specific concerns.

14.5 User Content & Interactions

You are solely responsible for:

  • The content you submit to the Service
  • Any consequences arising from your submissions
  • Your interpretation of content submitted by others
  • Your emotional and psychological response to content on the Service

We strongly encourage users who may be in emotional distress to seek professional support before, during, or after using this Service.

14.6 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Intelliquinte L.L.C., its officers, directors, employees, agents, and affiliates are NOT LIABLE for any indirect, incidental, special, consequential, punitive, or exemplary damages
  • This includes, without limitation, damages for loss of profits, goodwill, data, or other intangible losses
  • We are not liable for any harm, injury, or damages resulting from:
    • Your use of or inability to use the Service
    • Any content posted on the Service by you or others
    • Unauthorized access to your submissions
    • Any third-party conduct or content on the Service
    • Emotional or psychological impact from reading or writing content
    • Reliance on any information provided through the Service
  • Our aggregate liability shall not exceed $100 USD or any amounts you paid us in the prior 12 months, whichever is greater
  • This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise)

Some jurisdictions do not allow limitation of certain damages; in such cases, these limitations apply to the fullest extent permitted by applicable law.

14.7 Assumption of Risk

By using the Service, you expressly acknowledge and agree that:

  • Use of the Service is entirely at your own risk
  • You are solely responsible for your mental and emotional well-being while using the Service
  • You will seek appropriate professional help if you are experiencing a crisis
  • Intelliquinte L.L.C. has no duty to monitor, respond to, or act upon any submission

15. Indemnification

You agree to indemnify, defend, and hold harmless Intelliquinte L.L.C., its officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your Content or submissions
  • Your violation of these Terms
  • Your violation of any third-party rights

16. AI & Automated Content Detection

Dear Nobody uses automated systems, including artificial intelligence, to help protect our community and assist human moderators.

16.1 How AI Is Used

AI analysis occurs when you submit content. The AI:

  • Crisis Detection: Identifies content that may indicate a user is in distress, triggering display of crisis resources
  • Content Moderation: Flags submissions for human review based on potential policy violations
  • Theme Suggestion: Recommends appropriate categories for submissions

AI provides recommendations only—humans make all final decisions.

16.2 Technical Implementation

  • AI runs on Cloudflare's edge network (no third-party AI services like OpenAI or Google)
  • Primary model: Llama 3.1 8B, an open-source model by Meta
  • Fallback model: Llama 2 7B (used only when primary model is unavailable)
  • Your submissions are NEVER used to train AI — we use inference-only architecture
  • AI cannot identify you or link your submissions together
  • AI provides recommendations (approve/review/reject) that assist but never replace human moderators
  • Moderators can request re-analysis if the initial AI assessment seems incorrect

16.3 Crisis Resource Display

When our systems detect crisis indicators in your writing, we may:

  • Display crisis resources and hotline information before submission
  • Show a gentle follow-up screen with additional resources after submission
  • Flag the submission for priority moderator review

This is not crisis intervention—it is simply providing information. You can still submit your content. See Section 14.3 for our disclaimer about crisis services.

16.4 AI Limitations

Automated systems are not perfect. AI analysis may:

  • Miss content that violates our policies (false negatives)
  • Incorrectly flag content that does not violate policies (false positives)
  • Misinterpret context, tone, or intent
  • Be affected by writing style, language patterns, or cultural context

All flagged content is reviewed by human moderators before action is taken. We track our AI's accuracy and human override rate to continually improve.

16.5 Your Rights Regarding AI

You have the right to:

  • View your AI analysis: See exactly what AI detected about your submission using your Private ID in Access & Control
  • Know a human reviewed it: Every submission is reviewed by a human moderator
  • Request information: Contact us with your Public ID to learn more about how AI was used in moderating your specific submission
  • Delete your data: When you delete your submission, all associated AI analysis is also deleted

16.6 No AI-Generated Content Guarantee

While we discourage AI-generated submissions and may use detection tools, we cannot guarantee that all submissions are human-written. Users should understand that some content may be AI-generated despite our efforts.

17. Intellectual Property & User Rights

17.1 Your Retained Rights

You retain all ownership rights to the content you create and submit. Our license (Section 6) is non-exclusive, meaning you remain free to:

  • Publish your content elsewhere
  • Share your writing on other platforms
  • Develop your work into other forms

17.2 Platform Content

The Dear Nobody name, logo, website design, and original content created by Intelliquinte L.L.C. are protected by trademark and copyright law. You may not:

  • Use the Dear Nobody name or logo without permission
  • Create derivative services or products using our branding
  • Imply endorsement or affiliation without authorization

17.3 Feedback & Suggestions

If you provide suggestions, ideas, or feedback about the Service, you grant us a non-exclusive, perpetual, irrevocable license to use such feedback without compensation or attribution.

18. Communications & Notices

18.1 Service Notices

We may provide notices by:

  • Posting announcements on the Service
  • Updating this Terms of Service document
  • Displaying notifications through Editor's Notes

18.2 No Personal Communication

Because we do not collect email addresses or contact information, we cannot send individual notifications. You are responsible for periodically reviewing the Terms and any announcements on the Service.

18.3 Electronic Communications Consent

By using the Service, you consent to receive communications electronically. Any notices, agreements, or disclosures provided electronically satisfy legal requirements for written communications.

19. Severability, Waiver & General Provisions

19.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19.2 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

19.3 Entire Agreement

These Terms, together with the Privacy Policy and any other referenced agreements, constitute the entire agreement between you and Intelliquinte L.L.C. regarding the Service, superseding any prior agreements.

19.4 Force Majeure

Neither party shall be liable for any failure or delay in performing obligations under these Terms due to circumstances beyond reasonable control, including but not limited to: natural disasters, acts of government, pandemic or epidemic, cyberattacks, infrastructure failures, labor disputes, or acts of terrorism. During such events, affected obligations shall be suspended until the circumstances are resolved.

19.5 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or transfer of all or substantially all assets without your consent. Any assignment in violation of this section shall be void.

19.6 Export Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

20. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles.

20.1 Binding Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Intelliquinte L.L.C. agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding individual arbitration, rather than in court, except that either party may bring individual claims in small claims court if the claims qualify.

Arbitration Rules & Provider

  • Arbitration shall be administered by JAMS under its Streamlined Arbitration Rules and Procedures
  • The arbitration will be conducted by a single arbitrator in Wake County, North Carolina, or via telephone/video if mutually agreed
  • The arbitrator's decision shall be final and binding
  • Judgment on the arbitrator's award may be entered in any court of competent jurisdiction

Class Action Waiver

YOU AND INTELLIQUINTE L.L.C. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative, class, or collective proceeding.

Small Claims Court Exception

Either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction.

30-Day Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to legal@intelliquinte.com within 30 days of first using the Service. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of this arbitration agreement. If you opt out, you may pursue disputes in court as described below.

20.2 Litigation (If Arbitration Does Not Apply)

If for any reason a claim proceeds in court rather than arbitration:

  • Any disputes shall be resolved in the state or federal courts located in Wake County, North Carolina
  • You consent to personal jurisdiction in these courts
  • You waive any objection to venue in these courts

20.3 Informal Dispute Resolution

Before initiating arbitration or litigation, you agree to contact us at support@dearnobody.org and attempt to resolve any dispute informally for at least 30 days.

21. Changes to Terms

We may revise these Terms from time to time. When we do:

  • Updated Terms will be posted on this page with a new "Last Updated" date
  • Material changes may be announced on the Service
  • Continued use after posting constitutes acceptance of the new Terms

We encourage you to review these Terms periodically. If you disagree with changes, you should discontinue use of the Service.

23. Voluntary Contributions

23.1 Nature of Contributions

Dear Nobody accepts voluntary financial contributions to support the platform's operations. By making a contribution, you acknowledge and agree to the following:

Important Disclosures

  • For-Profit Status: Dear Nobody is operated by Intelliquinte L.L.C., a for-profit limited liability company. We are NOT a registered 501(c)(3) nonprofit organization.
  • Not Tax-Deductible: Contributions to Dear Nobody are NOT tax-deductible as charitable donations under U.S. tax law or the tax laws of most other jurisdictions. Consult your tax advisor for guidance specific to your situation.

23.2 Terms of Contribution

  • No Goods or Services: Contributions are voluntary gifts of support. You are not purchasing any product, service, or subscription. Contributors receive no special access, features, or privileges.
  • Non-Refundable: All contributions are final and non-refundable, except where required by applicable law or at our sole discretion.
  • No Influence: Contributions do not entitle you to any influence over Dear Nobody's content, policies, editorial decisions, or operations.

23.3 Use of Funds

Contributions are used at our discretion to support Dear Nobody's operations, including but not limited to:

  • Server and infrastructure costs
  • Human content moderation
  • Development and security improvements
  • Crisis resource maintenance
  • Operational sustainability
  • Charitable giving to mental health organizations (~15%)

Charitable Contribution Commitment

We commit to donating approximately 15% of all contributions to mental health organizations, including but not limited to crisis intervention services such as the 988 Suicide & Crisis Lifeline, Crisis Text Line, and similar organizations. This commitment reflects Dear Nobody's mission to support those who may be struggling.

We will publicly disclose which organizations receive these funds in our periodic transparency reports. The specific organizations and allocation may change, but our commitment to directing a meaningful portion of contributions toward mental health causes will remain.

Transparency Commitment: We voluntarily commit to publishing periodic transparency reports detailing how contributions are used. You can view our current allocation breakdown at /support. This commitment is voluntary and may be modified at any time.

23.4 Cryptocurrency Contributions

Contributions made via cryptocurrency are processed through third-party services (currently NowPayments). Cryptocurrency transactions are:

  • Subject to network fees paid by the sender
  • Final once confirmed on the blockchain
  • Not reversible by Dear Nobody

We are not responsible for transactions sent to incorrect addresses or lost due to user error.

23.5 Prohibited Contributions

We reserve the right to refuse or return contributions that we reasonably believe:

  • Originate from illegal activity
  • Are intended to influence our content, editorial decisions, or operations
  • Violate applicable laws or regulations
  • Come from sanctioned individuals or entities
